LOS ANGELES, CA - October 11, 2006 - Agents and brokers who have
been relying on marked up faxes to negotiate their deals now have
a much easier, more secure, legally binding - and paperless -
alternative. Thanks to the recent agreement between RPost(R)
(http://www.rpost.com) and SettlementRoom, RPost's Registered E-
mail service is now embedded into the SettlementRoom listing and
transaction management platform, giving SettlementRoom's 80,000+
registered users the ability to track, record, and verify the
content of their emails.
By combining RPost's Registered E-mail(R) services into the
SettlementRoom transaction management platform, agents, brokers,
title companies, lenders and builders can now conduct business by
e-mail and retain a verifiable and legally valid Registered E-
mail record of their correspondence.
According to Zafar Khan, CEO of RPost, "Once people start using
email for serious negotiations and confirmations, which most of
us do even without realizing it, it's just a matter of time
before one ends up in a dispute about the content of an important
email, or whether or not the email was ever sent at all. With
the Registered Email service, the sender gets a receipt, that can
later be used to legally verify the content and time sent and
received for any email. It's inexpensive, and the integration
with SettlementRoom is seamless."
Jonathan Cutler, President of SettlementRoom, adds, "Thousands of
our clients are trying to move toward paperless offices, and
surely the first step is to reduce use of the fax machine. With
the Registered Email service, many of the faxes we normally send
become unnecessary, saving time spent standing at the fax
machine, and reducing the need for filing, storage, toner, and so
many other associated costs."
The facts are that in the case of a dispute over content, timing,
sending or receiving of an e-mail, the archiving of that e-mail
in electronic or printed form provides very little protection
after the fact. With two clicks of the mouse, the recipient (or
sender) could change anything in a standard e-mail and claim it
to be the original e-mail. They can also easily delete an email
and claim it was never received. The Registered E-mail(R) service
by RPost provides the sender with legally valid evidence of time
and content, sent and received, for any Internet e-mail.
"Registered E-mail messages hold far greater evidential weight
than traditional mail, courier, fax, or e-mail, and therefore,
should provide the sender with protection that will stand up to
scrutiny in a dispute resolution situation. Registered E-mail
would provide the sender the upper hand in any legal discovery
disputes," states Judge Dana Senit Henry (ret.). "From the
perspective of a mediator, arbitrator, or judicial officer, one
looks first at the evidentiary value of what is submitted in
gauging its trustworthiness. Evidential weight is about reducing
uncertainty surrounding the evidence. The party with the greater
evidential weight will win in most cases, or at least mitigate
its liability."
